Rule 47 of the Arizona Rules of Family Procedure allows for either parent to file for temporary emergency order protections pending the outcome of the divorce or paternity proceeding. A divorce or paternity case can last for quite some time before a complete resolution can be reached.
In a Rule 47 hearing, you can request temporary child support and decision-making rights. However, most judges only issue orders of temporary legal decision-making once more information is provided to the court.
You can raise issues that you want the child to be removed from the state of Arizona with the prior approval of both parties or the court. A Rule 47 hearing gives you the advantage of allowing specific remedies without waiting for the divorce or paternity case to finish. The court will look to see if both parties have complied with temporary orders when making final decisions on these issues.
